Rtlinux has been a commercial venture for a long while - Since the release of
rtlinux-3.0 there has been an additional (and somewhat dubious IMO) patent
claim. The software license conflicts with the linux kernel license and has
been well reported on some of the news channels.

If you want to move away from rtlinux, there is rtai from
http://www.aero.polimi.it/projects/rtai/ which has the advantage of the
latest kernels being supported - Currently 2.4.9.
